RECAP: Understanding Migrant Exploitation with Attorney Maricel Weishede


On 10th May 2025, Banyuhay Aotearoa hosted an informative online session was held to raise awareness among migrants about their rights and how to protect themselves from exploitation. This session provided practical and legal advice on identifying exploitation, reporting it, and staying safe in New Zealand's workforce.

What is Migrant Exploitation?

Migrant worker exploitation happens when an employer takes advantage of a worker, creating financial, physical, or emotional harm. From unpaid wages to unsafe working conditions, exploitation can manifest in many ways.


Common Types of Exploitation

Migrant workers may experience exploitation in various forms, including:

  • Unpaid or underpaid wages.

  • Employers asking illegal fees to secure a job.

  • Unfair working conditions, like being asked to lie about hours worked or working without breaks.

  • Poor living conditions, such as overcrowded or unsafe accommodation.

  • Passport retention: Some employers unlawfully take workers' passports as a form of control.

If you are facing any of these situations, you should report it immediately.


How to Report Exploitation

If you are being exploited, reporting the situation is the first step towards getting help. Here’s how you can do it:

  • Call 0800 200 088: This is the Employment NZ helpline, available in over 180 languages. You can report exploitation in your preferred language.

  • Emergency situations: If you are in immediate danger, call 111 and ask for police assistance.

  • Support from Employment NZ: They will investigate your case and work with Immigration New Zealand to decide what action to take.


How to Keep Yourself Safe

Staying safe involves knowing your rights and taking proactive steps:

  • Don’t pay for a job: It’s illegal to be charged for employment.

  • Keep your documents safe: Your passport and personal information should always be in your control.

  • Get a written agreement from your employer and keep it.

  • Track your hours and payments: Record your work hours and ensure you are paid correctly.


Migrant Exploitation Protection Work Visa (MEPV)

If you are being exploited, you may be eligible for the Migrant Exploitation Protection Work Visa (MEPV). This visa allows you to leave an abusive employer and stay legally in New Zealand for up to 6 months while you search for a new job. For more details, please refer to Immigration New Zealand.
